Welcome to tryumfant.com (the “Site”), operated by TRYUMFANT LLC. (“TRYUMFANT,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Site, including any content, functionality, music, videos, community features, and AI services offered on or through it.

1. Acceptance of User Agreement

By accessing or using the Site in any way — browsing, streaming, purchasing, registering an account, submitting content, or interacting with Kairos™ — you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must stop using the Site immediately.
We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. Material changes will be reflected by an updated “Last updated” date at the top of this page.

2. Eligibility and Children’s Privacy

“Site Content” means music, lyrics, audio recordings, videos, Reels, articles, teachings, graphics, trademarks, logos, and other material created, owned, or licensed by TRYUMFANT LLC.
“User Content” means any content — including comments, text, photos, video clips, and reactions — that you post, upload, or submit through the Site.

4.2 User Content License

You retain ownership of your User Content. However, by posting User Content to the Site, you grant TRYUMFANT LLC. a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, sublicensable, and transferable license to use, reproduce, distribute, display, perform, and adapt that content to operate, promote, and improve the Site (e.g., displaying your comments on a Reel).

4.3 Content Restrictions

You represent and warrant that you own or have all necessary rights to your User Content. You agree not to submit any User Content that:

Is unlawful, defamatory, obscene, predatory, hateful, or harassing;
Infringes any third party’s copyright, trademark, privacy, or intellectual property rights;
Misrepresents Christian teaching in a deceptive, fraudulent, or malicious manner;
Contains malware, viruses, commercial solicitations, or spam.

4.4 License to Site Content

Subject to your compliance with these Terms (and payment of any applicable fees), TRYUMFANT LLC. grants you a limited, non-exclusive, non-transferable, revocable license to stream or download designated Site Content for your personal, non-commercial use only. You may not modify, distribute, publicly perform, broadcast, or resell Site Content without our express written consent.

5. DMCA Copyright Policy (Notice & Takedown)

TRYUMFANT LLC. respects the intellectual property rights of others. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond quickly to notices of alleged copyright infringement committed on our Site.

If you believe your copyrighted work has been uploaded or displayed on the Site without authorization, please send a formal DMCA Notice to our Designated Copyright Agent at legal@tryumfant.com containing:

A physical or electronic signature of the copyright owner or authorized representative;
Identification of the copyrighted work claimed to have been infringed;
Identification of the specific material on our Site that you claim is infringing (including URLs);

A statement, made under penalty of perjury, that the information in your notice is accurate.

6. Purchases, Payments, and Digital Sales

Pricing and Accuracy: All prices are displayed in USD unless otherwise stated. We reserve the right to change prices or discontinue products/services at any time.
All Sales Final on Digital Goods: Due to the instant nature of digital deliveries, all purchases of digital content (music downloads, streams, digital materials) are final and non-refundable once download or streaming access is granted, except as required by applicable law.
Services: Production, consulting, or ministry services booked through the Site are subject to separate, explicit agreements regarding scope and payment terms.

7. Kairos™ Bible Prophecy AI Chatbot

Educational & Devotional Nature: Kairos™ is an AI-assisted tool meant solely for educational, theological exploration, and devotional purposes.
No Substitute for Professional/Pastoral Advice: Responses generated by Kairos™ reflect algorithmic processing and TRYUMFANT LLC.’s theological framework. They are not a substitute for independent Bible study, pastoral counseling, or professional legal, medical, mental health, or financial advice.
AI Limitations and Indemnity: AI systems can produce inaccurate, incomplete, or flawed outputs (sometimes referred to as hallucinations). TRYUMFANT LLC. makes no warranties regarding the accuracy or reliability of Kairos™ outputs. You agree that your reliance on any chatbot output is entirely at your own risk, and you agree to indemnify TRYUMFANT LLC. from any claims resulting from your reliance on or use of such output.
Data Privacy: Do not input sensitive personal data, financial details, or confidential information into the Kairos™ interface.

8. Communications

By creating an account or signing up for our newsletter, you consent to receive electronic communications from TRYUMFANT LLC. regarding updates, releases, and ministry content. You can opt out of marketing emails at any time by clicking the “unsubscribe” link at the bottom of our emails.

9. Disclaimer of Warranties

THE SITE AND ALL SITE CONTENT, AI OUTPUTS (FROM KAIROS™), PRODUCTS, AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, TRYUMFANT LLC. DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TRYUMFANT LLC., ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR CONNECTED TO YOUR USE OF THE SITE, SERVICES, OR KAIROS™, REGARDLESS OF THE LEGAL THEORY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Dispute Resolution: Binding Arbitration & Class Action Waiver

Binding Arbitration: If we cannot resolve the dispute within 30 days, you and TRYUMFANT LLC. agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Kairos™ chatbot will be settled through binding, confidential arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules.
Class Action Waiver: YOU AND TRYUMFANT LLC. AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims unless all parties agree.

12. Governing Law and Jurisdiction

These Terms, your use of the Site, and any dispute arising hereunder shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. For any disputes not subject to binding arbitration, you and TRYUMFANT LLC. consent to the exclusive jurisdiction and venue of the state and federal courts located in California.
